1. Introduction

Welcome to the StreamPixel website, operated by Vardexa OÜ, a company incorporated in Estonia (“StreamPixel”, “we”, “us” or “our”).

These Website Terms of Use (“Terms”) govern your access to and use of the streampixel.io website and its publicly available content (the “Website”).

Your access to and use of the StreamPixel platform, dashboard, software, APIs, SDKs, pixel streaming services and other related products and services (collectively, the “Services”) are governed by the Streampixel End User License Agreement (“EULA”), available at: https://www.streampixel.io/policy/eula

If there is any conflict between these Terms and the EULA in relation to the Services, the EULA shall prevail.

2. Use of the Website

You may use the Website for lawful business and informational purposes.

You must not:

• use the Website for any unlawful or fraudulent purpose;

• attempt to gain unauthorized access to the Website, our systems or networks;

• interfere with, disrupt or compromise the security or operation of the Website;

• introduce viruses, malware or other harmful or malicious code;

• use automated means to scrape or extract information from the Website in a manner that materially interferes with its operation; or

• use the Website in a manner that infringes the rights of StreamPixel or any third party.

3. Streampixel Services

Information regarding StreamPixel’s products, features, pricing and Services may be made available through the Website.

Your purchase of, access to or use of the Services is subject to the EULA and, where applicable, any Order Form, Master Services Agreement or other written agreement entered into between you and StreamPixel.

In the event of any inconsistency, the order of precedence specified in the applicable EULA or signed agreement shall apply.

4. Intellectual Property

Unless otherwise stated, the Website and its contents, including text, graphics, designs, logos, trademarks, images, videos and other materials, are owned by or licensed to Vardexa OÜ and are protected by applicable intellectual property laws.

These Terms do not grant you ownership of any intellectual property belonging to Vardexa OÜ or its licensors.

You may access and use Website content for legitimate internal or informational purposes. You may not reproduce, modify, distribute, sell, sublicense or commercially exploit Website content without our prior written permission, except where permitted by applicable law.

Intellectual property rights relating to the StreamPixel platform, software, APIs, SDKs and Services are governed by the EULA.

5. Third-Party Websites and Services

The Website may contain links to third-party websites, products or services.

StreamPixel does not control and is not responsible for the content, availability, security or practices of third-party websites or services. Your use of third-party services may be subject to separate terms and policies established by the relevant third party.

6. Website Availability and Information

We endeavour to keep the Website available and the information presented on it accurate and up to date. 

However, we do not guarantee that the Website will always be available, uninterrupted, error-free or free from harmful components.

Information on the Website, including descriptions of features, availability, infrastructure, performance and pricing, may be updated from time to time.

Specific contractual commitments concerning the Services are governed by the applicable EULA, Order Form, Master Services Agreement or other written agreement, rather than general Website content.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Vardexa OÜ shall not be liable for any indirect, incidental, special, consequential or punitive damages arising solely from your access to or use of the Website.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

Any liability arising from your purchase of or use of the Streampixel Services is governed by the applicable EULA, Order Form, Master Services Agreement or other written agreement and not by this Section.

8. Suspension of Website Access

We may restrict or suspend access to all or part of the Website where reasonably necessary for security, maintenance, legal or operational reasons, or where these Terms have been materially violated.

Suspension or termination of access to the StreamPixel Services is governed separately by the EULA and any applicable written agreement.

9. Privacy and Data Protection

Our collection and use of personal data in connection with the Website is described in the Streampixel Privacy Policy.

Where Streampixel processes personal data on behalf of a customer in connection with the Services, such processing is governed by the applicable Data Processing Agreement (“DPA”).

10. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Website, our business practices, applicable law or operational requirements.

Updated Terms will be published on the Website with a revised “Last Updated” date. Where required by applicable law, we will provide additional notice of material changes.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict-of-law principles.

Any dispute relating exclusively to use of the Website shall be subject to the jurisdiction specified under applicable Estonian law, unless otherwise required by mandatory applicable law.

Disputes relating to the StreamPixel Services are governed by the dispute-resolution provisions contained in the applicable EULA or signed agreement.
